1. Using our website

By browsing or using this website, you agree to these Terms and our related policies (including our Privacy Policy and Returns Policy).
If anything is unclear, please contact us before placing an order.

2. Placing an order

When you place an order, you’re offering to buy from us.
A binding contract is formed once we send you a dispatch-confirmation email.
We may decline or cancel orders for reasons such as stock unavailability, pricing errors, or suspected fraud.
If payment is taken before an order is accepted, it will be refunded.

Order acceptance and refusal
We reserve the right to refuse, cancel, or suspend any order at our discretion, including (but not limited to) cases involving suspected fraud, previous chargebacks or payment disputes, misuse of payment systems, multiple or inconsistent customer identities, or breach of these Terms. If an order is cancelled, any payment received will be refunded in full.

3. Prices, VAT and payment

All prices shown include or exclude VAT as stated.
Prices may change before an order is confirmed.
You must provide accurate billing, delivery, and contact information.
Payment methods are shown at checkout and processed securely.

Chargebacks and payment disputes
If a customer initiates a chargeback or payment dispute in relation to any order, we reserve the right to refuse future orders from that customer. This includes cases where a chargeback is unsuccessful or resolved in our favour.

Unauthorised Chargebacks and Recovery of Funds

You agree that by placing an order, you are the authorised user of the payment method used and have full authority to complete the transaction.

You agree not to initiate a chargeback or payment dispute without first contacting us to resolve the issue.

Where a chargeback or payment dispute is initiated without valid reason (including where goods have been delivered as agreed), we reserve the right to:

Recover the full amount of the order, including any associated fees, administrative costs, and losses incurred
Pursue the outstanding balance through debt recovery or legal proceedings
Suspend or terminate any current or future orders

Nothing in this clause limits your statutory rights.

4. Delivery, risk and title

Delivery options, costs, and timescales are shown at checkout.
Risk passes to you once the goods are delivered. Ownership passes once we have received full payment.
Please check all deliveries as soon as they arrive.
If items are damaged or missing, contact us within 48 hours with photos so we can help resolve the issue.
This does not affect your statutory rights.

5. Courier services and delivery issues

We use trusted third-party couriers to deliver orders.
Once goods are handed to the courier, they are under the courier’s care until delivery.
We are not liable for delays, loss, or damage caused by the courier or by circumstances beyond our control (for example, weather, traffic, or missed deliveries).

If a parcel arrives damaged, please refuse delivery or sign as “damaged” and notify us within 48 hours.
We’ll help you resolve courier claims, but our responsibility is limited to replacing or refunding affected items once the courier confirms the issue.

6. Cancellations and Returns

If you wish to cancel your order, you must notify us in writing within 14 days of placing it by emailing info@clevershield.co.uk with your order number.

Do not return any items before receiving our return instructions. Once authorised, we’ll confirm the correct return address or advise if the goods should go directly to the manufacturer.

Unless the goods are faulty or supplied in error, you are responsible for return shipping costs and ensuring items are securely packaged.

Goods returned in a used, damaged, or non-resaleable condition may be refused or subject to repackaging fees. Returns due to ordering errors or change of mind are subject to a 25% restocking charge.

Your right to cancel does not apply to:

Custom-tinted, mixed, or bespoke products;
Goods made or ordered specially for you;
Items unsuitable for return for hygiene or safety reasons once opened; or
Business-to-business purchases.

Refunds are processed within 14 days of receiving returned goods or proof of return.

7. Product descriptions and variations

We aim to provide accurate images, descriptions, and colours. However, small variations may occur due to lighting, packaging, or manufacturer updates.

8. Installation and product use

Our waterproofing and protective products must be installed exactly as stated in the manufacturer’s data sheets and relevant British Standards (such as BS 8102, BS 8217, and BS 8485).
It’s your responsibility to check the substrate, preparation, mixing, and conditions before use.
We cannot accept liability for issues caused by incorrect installation, misuse, or unsuitable conditions. This does not affect your statutory rights.

9. Technical Information and Manufacturer Support

Any technical information, data sheets, calculators or other product information displayed or provided by Clever Shield Limited is provided for general information and purchasing purposes and is based, where applicable, on information supplied by the relevant manufacturer.

Customers should always refer to and follow the manufacturer's most up-to-date Technical Data Sheet (TDS), Safety Data Sheet (SDS), application instructions and other relevant technical documentation before using a product.

Where a manufacturer offers technical design, system specification or application-specific advice, Clever Shield Limited may liaise with the relevant manufacturer on behalf of the customer to obtain or facilitate such information. Any design, specification, technical recommendation or application-specific advice provided by the manufacturer remains the responsibility of the relevant manufacturer.

Clever Shield Limited does not independently design, engineer or specify products or systems. Our role in relation to manufacturer technical services is limited to supplying products and, where appropriate, facilitating communication between the customer and the relevant manufacturer.

Nothing in this section affects any statutory rights or legal obligations that cannot lawfully be excluded or limited.

10. Promotions and offers

Promotions, price matches, and delivery promises are subject to availability and may change at any time.
“Next-day delivery” applies only to qualifying mainland UK orders placed before the specified cut-off time, subject to courier capacity and stock.

11. Website use and intellectual property

You must not use this site for illegal purposes, upload harmful content, or infringe on intellectual-property rights.
All website content belongs to Clever Shield Limited or our licensors and may not be copied or reused without permission.

12. Third-party websites and services

Our website may link to other websites. We are not responsible for their content, accuracy, or actions.
Use of third-party sites is at your own discretion and subject to their own terms.

13. Privacy

Your personal data is handled in accordance with our Privacy Policy.
Payment information is processed securely by our payment partners under PCI-DSS standards.

14. Our liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

For consumers, our total liability for any order is limited to the amount you paid for that order. We are not responsible for indirect or consequential loss, such as loss of profit, business interruption, or data loss. Your statutory rights are not affected.

Business customers:
All implied warranties are excluded to the fullest extent allowed by law.
Our total liability is limited to the value of your order.
We exclude indirect or consequential loss.

15. Complaints and dispute resolution

We aim to resolve all issues quickly and fairly.

16. Updates to these Terms

We may update these Terms occasionally. The version in place at the time you placed your order will apply to that order.

17. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be handled exclusively by the courts of England and Wales.

18. Product Information, Suitability & Application

Clever Shield Limited acts as a distributor and supplier of products manufactured by third-party manufacturers. We do not manufacture, design, engineer or independently specify products or systems for particular applications.

Product information provided on our website, including descriptions, technical information, coverage rates, application information and other product details, is provided for general information and purchasing purposes and is based on information supplied by the relevant manufacturer.

Customers are responsible for ensuring that products are suitable for their intended application and are used correctly in accordance with the manufacturer's requirements.

Manufacturers may change product formulations, specifications, application methods, coverage rates, curing times and other technical information from time to time. Customers should therefore ensure that they are using the current documentation applicable to the product supplied.

Where there is any difference between information displayed on our website and the manufacturer's current technical documentation, the manufacturer's current technical documentation should be followed.

Where a manufacturer offers technical design, system specification or other application-specific advice, Clever Shield Limited may liaise with the relevant manufacturer on behalf of the customer to obtain or facilitate such information. Any design, specification, technical recommendation or application-specific advice provided by the manufacturer remains the responsibility of the relevant manufacturer and is not independently produced or verified by Clever Shield Limited.

Clever Shield Limited does not provide independent system design, engineering, structural design or product specification services. Our role in relation to manufacturer design or specification services is limited to facilitating communication and liaising between the customer and the relevant manufacturer.

Nothing in this section is intended to exclude or limit any statutory rights or legal obligations that cannot lawfully be excluded or limited.
